Raffles, Co-Ventures, Crowdfunding & Beyond: Legal Issues with Common Fundraising Methods

This webinar will focus on the legal framework and ramifications of popular fundraising methods to help nonprofits make informed decisions on development strategy. Many nonprofits engage in raffles and co-ventures with for-profit entities. They are however rarely aware of the state regulations governing these activities. Online fundraising including crowdfunding is also popular for nonprofits with limited resources. As the practice becomes mainstream and online tracking data becomes increasingly easily obtainable, nonprofits need to be aware of the legal framework involving Federal Trade Commission for such activities as part of their corporate governance strategy.

Please join Elizabeth Reinhardt and Christopher Leigh-Manuell who will discuss these emerging areas of fundraising for nonprofit organizations. The session will start with the fundamental legal underpinning of charitable fundraising -- the donation being kept in trust -- to help nonprofits understand the ramifications of their fundraising. It will then give an overview of the regulations on registration with state Attorneys General, raffles, co-ventures, fundraising professionals, and crowdfunding to help nonprofit board and management make informed decisions when strategizing development.

Just a sampling of what this webinar will cover:

  • Basic legal underpinning of charitable fundraising, donor intent, gift restrictions, and acknowledgements
  • Different types of state charity registrations and what activities typically trigger a registration requirement
  • Multi-state fundraising
  • General guidance about solicitation from individuals, co-ventures, crowdfunding, and online-giving portals
  • Professional fundraisers: solicitor versus counsel, contracts, reporting, and registration
