Many nonprofit organizations depend on volunteers and could not accomplish their mission without the volunteers' dedication, hard work and long hours. However, volunteers also generate controversy and potential liability. Some may cross the boundaries and generate liability for injury or improper actions toward clients or employees. Your organization, and you personally, may be liable for negligently selecting, monitoring or retaining volunteers who cause harm. Some disgruntled "volunteers" have claimed that they were not "volunteers" at all and are now due wages, back pay and benefits for two or three years under federal Fair Labor Standards Act requirements. Some win! The standards can be confusing, and every nonprofit should understand the laws, standards and obligations in order to avoid the dangers and be able to effectively use volunteers to accomplish their mission. Bob Gregg
Mr. Gregg is a partner with Boardman & Clark Law Firm in Madison, Wisconsin. Mr. Gregg has been involved in employment relations for more than 30 years. He litigates employment cases, representing employers in all areas of employment law. His main emphasis is helping employers achieve enhanced productivity. He has designed the policies of numerous employers, creating positive work environments and resolving employment problems before they generate lawsuits. Mr. Gregg has conducted more than 3,000 seminars throughout the United States and authored numerous articles on practical employment issues. He is a member of the Society for Human Resource Management, the National Speakers Association, a National Faculty Member of the American Association for Affirmative Action and serves on the board of directors of the Department of Defense Equal Opportunity Management Institute Foundation. In addition, he has been both a volunteer as well as a professional employee of nonprofit organizations. He represents in his practice state and national nonprofits, has designed volunteer and internship policies and agreements, and has successfully defended nonprofits in government audits and suits regarding volunteerism and volunteer behaviors. He received his master of social work (MSW) and law degrees (JD) from West Virginia University.
